Chapter One: Introduction
1.1 Background of the Study
Freedom of religion is enshrined as a fundamental human right in the Nigerian Constitution, ensuring that every citizen has the right to practice their religion freely, without fear of persecution (Suleiman & Chukwu, 2023). In Jos North LGA, Plateau State, the diversity of religious practices and beliefs has led to tensions at times, particularly between Muslim and Christian communities. While the constitution guarantees religious freedom, the reality in some regions of Nigeria, including Jos North, has been characterized by instances of religious intolerance and discrimination (Adeyemi & Lawal, 2024). The enforcement of constitutional provisions on freedom of religion is thus critical to maintaining peace and harmony in such pluralistic societies. This study aims to assess how well these constitutional provisions have been implemented in Jos North LGA, considering both the legal framework and the social dynamics that influence religious freedom in the area.
1.2 Statement of the Problem
Despite the constitutional guarantee of religious freedom, religious intolerance and violence remain prevalent in Jos North LGA. This study seeks to explore the gap between constitutional provisions and their implementation, identifying the challenges faced in protecting religious rights and recommending ways to enhance the effective enforcement of these provisions.
1.3 Objectives of the Study
To assess the implementation of constitutional provisions on freedom of religion in Jos North LGA.
To identify the challenges hindering the effective implementation of religious freedom laws in the area.
To propose measures for improving the enforcement of constitutional provisions on freedom of religion in Jos North LGA.
1.4 Research Questions
How effectively are constitutional provisions on religious freedom implemented in Jos North LGA?
What are the challenges in ensuring the protection of religious freedom in Jos North LGA?
What strategies can be adopted to improve the enforcement of constitutional provisions on freedom of religion in Jos North LGA?
1.5 Research Hypothesis
H₁: Constitutional provisions on freedom of religion are not effectively implemented in Jos North LGA.
H₂: Religious intolerance and socio-political factors hinder the enforcement of religious freedom in Jos North LGA.
H₃: Strengthening the legal enforcement of religious freedom provisions will improve interreligious relations in Jos North LGA.
1.6 Significance of the Study
This study will contribute to the understanding of the challenges and opportunities in the implementation of religious freedom provisions within the Nigerian constitutional framework. It will help policymakers, religious leaders, and human rights advocates better address issues of religious intolerance and promote a more inclusive society in Jos North LGA.
1.7 Scope and Limitations of the Study
The study will focus on the implementation of constitutional provisions on freedom of religion in Jos North LGA, Plateau State. Limitations include the sensitivity of the topic, which may result in difficulty accessing data, especially concerning sensitive issues such as religious violence and intolerance.
1.8 Operational Definition of Terms
Freedom of Religion: The right to practice, change, or hold religious beliefs without interference or persecution.
Constitutional Provisions: Legal rules and principles established by the Nigerian Constitution to safeguard fundamental human rights, including religious freedom.
Religious Intolerance: Hostility or discrimination against individuals or groups based on their religious beliefs or practices.
